Prostitution is the intent to engage in a sexual act in exchange for money or anything of value. You must show intent by taking an action towards the agreed exchange (i.e. getting into a car, exchanging money).
In California, prostitution is a crime and the prostitute, customer (or “John”), and middleman (often a pimp) may all be arrested and charged.

A first offense for prostitution is a misdemeanor and the potential penalties include up to 6 months in jail and a fine up to $1,000.
